• Arbitration and Conciliation Act, 1996 (26 of 1996) S. 16(2), 4 - Appellant had written two letters to the arbitrator challenging the arbitration proceedings but thereafter absented - Exparte award passed appellant had chosen to file a civil suit by invoking territorial jurisdiction of the Court at Bangalore by giving incorrect address of defendants (therein) and respondents herein and obtained ex-parte<D> decree and on transfer of the ex-parte<D> decree notice was sent at the correct address - An application under Order 9 Rule 13 CPC was filed which is stated to be pending and there is interim stay - Challenging jurisdiction - In essence deemed to have waived the right as per Section 4 of 1996 Act. (183) P.L.R.
