• Central Civil Services Rules, 1971, Rule 38(1), 49(1) - Rule 49(1) would operate only in the case of normal pension, whereas Rule 38(1) specifically deals with invalid pension - In the present case, action of the respondent authorities has been found to be arbitrary on the face of it for the reason that a soldier, who suffered 100% disability because of the serious infection in his eyes and he has become totally blind, has been treated by the respondents in a very casual and irresponsible manner. (178) P.L.R.
  • Central Civil Services Rules, Volume I, Rule 8.127(1), Note (4) - Birth of third child - Maternity leave - Working as teacher - Respondent are directed to grant benefit of maternity leave - Maternity Benefit Act, 1961 (53 of 1961) S. 27.  (179) P.L.R.
  • Central Services Rules, Rule 8.75 - Deals with temporary employees (other than those employed on contract basis) and arises in situations on account of retrenchment or on abolition of posts before reaching the age of superannuation even when it is not applied for and refused in the public interest - Thus, there is a clear difference between `terminal leave' and `leave encashment'. (182) P.L.R.
