• Civil Procedure Code, 1908 (V of 1908) S.  13, Order 7 Rule 13 - Judgment of Foreign Court - Adjudication cannot be foreclosed simply on account of presence of the foreign court decree - As both the parties pursued parallel matrimonial reliefs in different jurisdictions thereby giving rise to conflict on the issue of consent - Accordingly, it was imperative to resolve the issues arising out of such a consent and settle the matter - Principles are summarized for guidance of matrimonial courts functioning within the territories over which this court exercises jurisdiction but with a word of caution that they should be applied on a case to case basis while dealing with applications under Order VII Rule 11, CPC in the context of HMA - Hindu Marriage Act, 1955 (25 of 1955).
