• Civil Procedure Code, 1908 (V of 1908) S.  36, Order 21 Rule 10, Section 100 - Execution petition has been dismissed not only on the ground of limitation but on other grounds also - The appellate court also observed that as the appellants have already been dispossessed from the suit property in the year 1996 according to their own admission, therefore, there was nothing to be executed - There is no decree passed by the executing court or even by the first appellate court - The said two courts were only executing the decree which was passed in favour of the appellants way back in the year 1980 the order is not an order in the nature of decree and therefore cannot be subjected to second appeal.
