Rules, 2012, Rule 9 - Contemplates that PGT Computer Science are to be appointed by direct recruitment on con tract basis or by transfer ordeputation - Prescribed a post-graduate in MCA or M.Sc. in Computer Science after undergoing
regular course cannot be said to be illegal or arbitrary which may warrant interference in the writ jurisdiction of this Court. (182) P.L.R.

Essential qualifications prescribed for Post Graduate Teacher (PGT)Computer Science wherein only M.Sc. Computer Science/Master in Computer Applications (for short `MCA') through regular
course are made eligible for consideration for appointment - The mode of obtaining degree through regular course is a facet of higher qualification and thus would fall within the executive
domain - Such condition is a class classification which has reasonable nexus with the object of imparting education to the school going children. (182) P.L.R.

Rules, 2012 - Rule 5 Proviso - Relaxation of Upper age - That relaxation in upper age limit is to be granted to a candidate which is being denied - That relief is to be given once in the life
time - No provision was provided for relaxation to the candidates having teaching experience in terms of proviso to Rule 5 of the Rules - It will be too harsh to interpret the Rules to mean
that relaxation would mean only in the first advertisement issued after framing of the Rules rather it should be understood to mean that the relaxation is available to a candidate once for
his/her appointment - The experience, the relaxation for which is being granted is only for teaching in privately managed Government aided, recognized and Government schools and not in some
small tutor types shops - In the recognized, privately managed Government aided schools, there is some control on the quality of teaching as well, hence, the relaxation in age to these
categories of candidates is to be granted once for his/her selection and not for any subsequent selection. (179) P.L.R.
