Limitation Act, 1963 (36 of 1963), Section 19 - Thus, it is clear that when part payment is made before the expiration of the prescribed period of limitation by the person liable to pay the debt, a fresh period of limitation shall be computed from the time when the payment was made, however where last payment in lieu of debt was received after the period of limitation of 3 years (30th May 2015 liability is on account of invoice dated 13th December 2011) - Limitation period cannot be extended. 2020 SCeJ 1226 (NCLAT)
Limitation Act, 1963 (36 of 1963), Section 19 - Balance confirmation made after the expiration of the limitation period, i.e. three years shall not extend the period of limitation. (Invoice dated 13th December 2011, last payment in lieu of debt 30th May 2015 balance confirmation made on 01st April 2017 shall not extend limitation. 2020 SCeJ 1226 (NCLAT)
